Terms of Service
1. Acceptance of Terms
By accessing and using ServicePay ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
2. Description of Service
ServicePay provides a cloud-based platform for tradespeople to manage quotes, jobs, invoices, customers, and scheduling. ServicePay is a technology platform — it is not a bank, payment institution, or e-money issuer.
3. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.
4. Subscription & Payment
Paid plans are billed monthly. You may cancel at any time and your access will continue until the end of your billing period.
5. ServicePay Payments
ServicePay offers an optional card payment facility ("ServicePay Payments") that allows your customers to pay invoices by debit or credit card. This section applies if you enable ServicePay Payments.
5.1 Payment Processing
All card payments are processed by Stripe Payments UK Ltd, a company authorised by the Financial Conduct Authority (FCA) as an Electronic Money Institution (FRN 900461). ServicePay does not process, hold, or transmit card payment data. ServicePay acts solely as a technology intermediary connecting your business with Stripe's payment infrastructure.
5.2 Fees
ServicePay charges a platform fee on each successful card transaction of 1.4% + 80p, capped at 2.5% of the transaction less 20p, with a minimum of 30p. Stripe collects this as an application fee at the time of the charge. It is a charge for ServicePay's technology services, not a payment service fee.
Stripe charges its own processing fees directly to your Stripe account under your agreement with Stripe. Those fees are set by Stripe, not by ServicePay. Together the two typically come to about 2.9% + £1 on a standard UK card, and no more than 4% on a smaller transaction; the exact total depends on Stripe's pricing and on the card used. Card payments have a minimum of £20 — below that the fixed element of both fees exceeds 4% of the transaction, so ServicePay does not offer card payment on smaller amounts. International, commercial and American Express cards cost more to process.
5.3 Payouts
Card payments are made directly to your own Stripe account. ServicePay does not receive, hold or pay out your funds at any point.
Stripe pays your balance to the bank account registered on your Stripe account, on the payout schedule set there, which you control from your Stripe dashboard. Settlement timing, minimum payout amounts and any payout holds are governed by your agreement with Stripe, not by these Terms.
5.4 Verification & Limits
Stripe verifies your identity and your business before your account can accept payments or receive payouts, and may request further information at any time. Stripe may hold payouts where its verification or risk requirements are not met. Those decisions are Stripe's.
ServicePay may suspend your ability to take card payments through ServicePay where we reasonably suspect fraud or a breach of these Terms. ServicePay cannot release, delay or redirect funds held in your Stripe account.
5.5 Disputes & Chargebacks
If a customer disputes a card payment, Stripe debits the disputed amount from your Stripe balance while the dispute is investigated, and returns it if the dispute is resolved in your favour. ServicePay does not hold those funds and cannot withhold, release or return them. ServicePay will help you assemble the transaction evidence to submit to Stripe, but cannot guarantee the outcome of any dispute. You are responsible for maintaining adequate records (signed-off work, before/after photos, customer communications) to support dispute resolution.
5.6 Prohibited Activities
You must not use ServicePay Payments for transactions unrelated to trade services rendered, personal transfers, or any activity that breaches Stripe's Restricted Businesses policy. ServicePay reserves the right to suspend payment facilities immediately upon detection of prohibited activity.
5.7 Relationship Clarification
Your agreement to accept card payments is between you and Stripe. ServicePay facilitates onboarding and provides the technology interface but is not a party to the payment processing relationship. Stripe's Connected Account Agreement governs your use of card payment processing.
6. Data Ownership
You retain ownership of all data you enter into ServicePay. We will not sell, share, or use your data for purposes other than providing the Service.
7. Limitation of Liability
ServicePay is provided "as is". We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. ServicePay is not liable for payment processing delays, failures, or disputes handled by Stripe, nor for any loss arising from chargebacks or fraudulent transactions.
8. Changes to Terms
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.
